Can you sell CBD on Amazon?

Type “CBD” into the Amazon search bar and hundreds of results pop up, all claiming to sell some form of CBD oil, and even Cannabis-sativa oil. Here’s the bad news: every one of these products is fake, and it’s still illegal to sell CBD on Amazon.

A look at Amazon’s restricted product policies (below) reveals that none of the “CBD” advertised on their site actually includes cannabidoil or hemp oil, but rather hemp-seed oil (or, in the case of the many of the advertised products, grapeseed oil).

Amazon CBD policy as of May 2019

Drug listings must not be for controlled substances or products containing controlled substances, such as:

  1.  Products containing cannabidiol (CBD), a Schedule I Controlled Substance, including but not limited to:
    1.  Rich Hemp Oil containing cannabidiol (CBD)
    2.  Products that have been identified as containing CBD by LegitScript
  2.  Hemp products containing Resin or tetrahydrocannabinol (THC)
  3.  Hemp (or any cannabis Sativa spp. strain) seeds capable of germination

What’s the difference between CBD and hemp-seed oil?

Hemp-seed oil is entirely different than CBD, and doesn’t have the same benefits to users. Authentic CBD products will include CBD, hemp CBD, or phytocannabinoid-rich hemp oil on their labels, and offers users analgesic and anti-inflammorty properties. Hemp-seed oil is essentially the same as sunflower oil or jojoba oil, and has zero cannabinoids in it.

False advertising of CBD on Amazon

Selling CBD on Amazon

Brian Baum, the CEO of a large CBD manufacturer named Cannovia, said that Amazon is doing its customers a disservice by allowing sellers to advertise hemp-seed oil products as CBD. Customers end up thinking CBD does nothing to help them, and they never try an authentic product with health and wellness benefits

.

“I think Amazon could single-handedly set the industry back … by trying to do good. They’re really just confusing their customers,” says Baum of the issue.

With their current policies, you can’t sell CBD on Amazon. But even traditional retailers like CVS and Walgreens are dipping their toes into the CBD industry, which will likely create momentum for Amazon to consider a change in the future.
